What is the new law about abortion in Georgia?

On July 20th, 2022, Georgia House Bill 481 went into effect. This bill was originally passed in 2019, however a lawsuit prohibited it from going into effect immediately. On June 24th, 2022, the Supreme Court voted to overturn Roe v. Wade and declared that abortion was unconstitutional. This allowed individual states to make their own laws about abortion.

Before July 2022, women were able to have an abortion up to 20 weeks gestation in Georgia. Now, the new law allows women to have an abortion only if there is no detectable heartbeat. The heartbeat is usually identified around 6 weeks gestation. Gestational age can be measured by the first day of your last period, although it can differ based on ovulation and implantation. Gestational age is best measured by an ultrasound.

There are 3 exceptions to the Georgia abortion law. These exceptions are:
  • Rape or incest, with a filed police report after the incident occurred.
  • The woman faces harm or potential death if the pregnancy continues.
  • The baby has a health condition that would likely result in death.
When you sign your consent for an abortion, you are saying that the doctor has told you about:
  • Your medical risks associated with the chosen abortion procedure
  • The probable age of the fetus and presence of a detectable human heartbeat at the time the abortion is scheduled
  • Your medical risks if you decide to carry the pregnancy to term
Your consent also notes your doctor has provided information that:
  • You may be eligible for medical coverage of prenatal care, childbirth, and newborn care
  • Fathers are required to assist in child support
